Ministry: Products need govt MC stamp of approval for sales starting Aug 1

PETALING JAYA: Toys for children will carry a government-approved safety logo from Aug 1 as proof that they had been tested and certified safe.

The black and white logo or MC (mark of conformity) with a serial number from the Domestic Trade, Co-operatives and Consumerism Ministry, must be affixed on every toy on sale.

It is proof that the toys had been tested and certified safe by the International Laboratory Accre­ditation Cooperation or Asia Pacific Laboratory Corporation.

Under the ministry’s new ruling, the toy industry (importers, local manufacturers and those doing the packaging) must provide the certification for their goods, when applying to the ministry for the MC.

The ministry’s deputy secretary-general, Mahani Tan Abdullah, told The Star that the industry must have the MC issued first before importing, manufacturing or packaging the toys. She said existing goods (prior to Aug 1) could still apply for the MC, adding that the move would affect about 3.9 million toys which were already in the market.

“Goods without the MC are allowed to be on sale until Jan 31 next year,” Mahani said.

She said the six-month grace period, beginning next month, was meant for the industry to clear their old stocks.

“Each and every toy on sale from Feb 1, 2011 must have the MC.”

She said the MC and the serial number would enable the ministry to take action in the event of any complaint. Prior to the ruling, there is no mark on the toy product which would allow consumers to know whether it had been approved by the authorities, she said.

Mahani said the new requirement would set a safety standard for all toys, particularly those meant for children below five years.

She said the toys, where necessary, must also come with a warning and/or information in Bahasa Malaysia or English or both.

Additional languages may also be used.

Nevertheless, she said it was the duty of parents to ensure their children’s safety at all times.

Deputy Minister Datuk Tan Lian Hoe urged the industry to adhere to the ruling which came under the Consumes Protection Act.

Consumers should report to the ministry if they found any toy without the MC beginning Feb 1, she said.

Traders ask for more time to dispose of old stock

PETALING JAYA: Toy traders may have to slash their prices up to 50% if they are to clear their existing stock fast, following the implementation of a new ruling requiring all new toys sold in the country to carry the mark of conformity (MC) logo.

Malaysian Foodstuffs and Toys Merchants Association (toys division) chief Datuk Ooi Soo Hing said its members were concerned about suffering loses as their current stocks which have yet to be sold was worth between RM300mil and RM500mil.

“If they are to clear their existing stock fast, they may have to slash prices up to 50%,” he said.

The Domestic Trade, Co-operatives and Consumerism Ministry has announced the implementation of the new ruling effective next month for new stock and Feb 1 next year for existing stock.

Traders can either apply for the MC for their old stocks, or dispose of them by Jan 31 next year under the six-month grace period given by the ministry.

Ooi said there were about 30 major toy importers and 10 local toy manufacturers in the country.

“We can apply for the MC for our existing stocks, but we need time to do so,” he said, adding that representatives from the industry had, during a dialogue with the ministry on July 6, requested to be given one year to clear their goods.

“Importers particularly will be affected.

“They already paid for things like duty, logistic and other fees,” said Ooi. Imported toys are mostly from China, Europe, Australia and the United States. Federation of Malaysian Consu­mers Association (Fomca) secretary-general Muhammad Sha’ani Abdullah, who welcomed the ruling, said the ministry should enforce it without any delay.

The children’s interest must be above that of the traders, he said when commenting on the industry’s request for a year to clear their old stocks.

“With the MC on every toy, consumers can rest assured that the toys that they are buying are lab-tested and certified safe.

“Parents should make sure they buy only toys with the MC and also continue to monitor their children closely to avoid accidents,” he said.

14歲以下兒童玩具
強制貼安全認證標籤

依斯邁沙比里說,從8月1日開始,強制玩具進出口商及製造商,所代理或生產的14歲以下兒童玩具,必須貼有馬來西亞合格標誌(MC)安全認證標籤。

他說,有關條例在8月1日生效后,該部執法官員將隨時檢舉兒童玩具進出口商及製造商,違反者將受對付。

他指出,在1999年保護消費人法令中已納入兩項新條例,即2009年保護消費人條例(遵照認證及安全標準規格標籤)及2009年保護消費人條例(玩具安全標準)。

“此條例只約束14歲以下的兒童玩具,至于文具用品安全格規,不包括在內。”

马来西亚国内贸易、合作社及消费部长拿督依斯迈沙比利宣布,原订於2010130日开始实行的儿童玩具安全标准条例,由於一些技术上的问题,决定展延至201071日,才正式执行。这两项涵盖儿童玩具安全标准程序及7项安会规格的条例为:

i)                    2009年保护消费人条例〔符合安会规格的认证与标记〕及

ii)                   2009年保护消费人条例〔玩具的安全规格〕

 1)     政府制定这两项条例的主要目的

 -   为了确保在马来西亚市场上所售卖的儿童玩具都符合安全规格

-   2009年保护消费人条例下阑明, 玩具意指为14岁以下儿童玩耍用途所设计和制造的任何物品,但不包括此条例表二内所注明的物品

 

2)     有关於实施这两项条例的状况

-   这两项条例经於30-07-09在宪报上公布,并原订於30-01-10实行。这意味政府已经给于业者6个月的宽限期,把库存及市场上不符合安全规格的存货售罄。

-   然而,业者给予贸消部的反映为,大马工业研究及规格有限公司(SIRIM QAS SDN BHD)所提出的检验费用太高,对业者是一个重大的负担。

-   因此,经过与各知名品牌业者、马来西亚食品及玩具商公会、马来西亚零售商公会及其他相关单位的多次对话后,贸消部决定采取 自行申报方式来实施这两项条例。

-   由於考虑到贸消部将修改实施这两项条例的方式,业者要求该部把实施的日期延后。

-   业者需要充裕的时间进行盘点市场上的库存货,仝时向海外厂家处理经已下订的货品。

-   基於上述因素,这两项有关儿童玩具安全条例的实施日期将展延至01-07-2010

 3)     自行申报机制

-   在自行申报机制下,业者必须为本身进口、出产及售卖的玩具申报,确定物品符合上述条例所指定的安全需求。

-   业者必须为所申报及提呈之资料的正确性负责。

-   在海关或贸消部执法官员之要求下,业者必须出示相关物品之化验报告。

-   自行申报机制将适用於即将进口、生产及目前市场上现有的玩具。

-   一般上,业者所必须依据的步骤如下:

i)  进口商必须於进口的时候,向海关呈交自行申报表格,副本交贸消部存档。

ii) 本地制造商则必须向贸消部呈交所出产之物品的自行申报表格。

-   在此机制下,业者必须妥善保存所有资料及货品销售纲的档案,以便贸消部官员随时检查。

 

4)     采用自行申报机制的理由

-   采用自行申报机制可减轻业者在检验费用的负担。

-   简化程序,以便业者更容易适应此两项条例。

-   马来西亚缺乏相关的化验室。

 

5)     总结

-   虽然政府采纳 自我负责的概念,但是业者还是必须确保所售卖的玩具仍依据政府所规定的安全标准进行化验。政府有关当局将不会对任何有危害到安全的事件妥协,以保障消费人的权益。

· NAMUN DEMIKIAN, KEMENTERIAN TELAH MENDAPAT MAKLUM BALAS DARI PIHAK INDUSTRI BAHAWA KOS YANG DITAWARKAN OLEH SIRIM QAS INTERNATIONAL SDN. BHD. BAGI PENGELUARAN LAPORAN PENILAIAN PEMATUHAN ADALAH MEMBEBANKAN MEREKA.

· JUSTERU, BERDASARKAN BEBERAPA SIRI KONSULTASI DENGAN PIHAK INDUSTRI YANG TERDIRI DARIPADA SYARIKAT MATTEL, SRI CINMAL, HASBRO, TOY ‘R US, PERSATUAN SAUDAGAR MAKANAN DAN PERMAINAN MALAYSIA, PERSATUAN PERUNCIT MALAYSIA (MRA) DAN LAIN-LAIN, KEMENTERIAN MEMUTUSKAN UNTUK MENGAMBIL LANGKAH ALTERNATIF UNTUK MELAKSANAKAN KEDUA-DUA PERATURAN INI IAITU MELALUI KAEDAH SELF DECLARATION.

3.   KAEDAH SELF DECLARATION

· SELF DECLARATION ADALAH MERUPAKAN PENDEKATAN DI MANA PIHAK INDUSTRI DIKEHENDAKI MENGISYTIHARKAN BAHAWA MAINAN KANAK-KANAK YANG DIIMPORT, DIKILANGKAN ATAU DIJUAL ADALAH MEMATUHI KEPERLUAN-KEPERLUAN YANG DIGARISKAN DI BAWAH KEDUA-DUA PERATURAN BERHUBUNG STANDARD KESELAMATAN BAGI MAINAN

· PIHAK INDUSTRI ADALAH BERTANGGUNGJAWAB TERHADAP PENGISYTIHARAN YANG DIBUAT SERTA KETEPATAN MAKLUMAT YANG DIKEMUKAKAN.

· PIHAK INDUSTRI PERLU MENGEMUKAKAN TEST REPORT  DI ATAS PERMINTAAN SEMASA PENGUATKUASAAN DIJALANKAN OLEH PIHAK KASTAM ATAU KPDNKK.

· KAEDAH INI ADALAH TERPAKAI SAMA ADA BAGI BARANG MAINAN YANG BARU HENDAK DIIMPORT ATAU DIKILANGKAN MAHUPUN BAGI MAINAN YANG SEDIA ADA DI PASARAN.

· SECARA AMNYA, PROSEDUR YANG PERLU DIIKUTI OLEH PIHAK INDUSTRI DALAM MEMATUHI PERATURAN INI ADALAH :

(i)      PENGIMPORT DIKEHENDAKI MENGEMUKAKAN BORANG PENGISYTIHARAN (SELF DECLARATION FORM) KEPADA KASTAM DI PINTU-PINTU MASUK NEGARA DAN SESALINAN AKAN DIKEMUKAKAN KEPADA PIHAK KEMENTERIAN UNTUK TUJUAN REKOD.

(ii)    PENGILANG TEMPATAN PULA DIKEHENDAKI MENGEMUKAKAN BORANG PENGISYTIHARAN KEPADA KEMENTERIAN INI BAGI SETIAP PENGELUARAN BARANG MAINAN BERKAITAN.

· DENGAN PENDEKATAN INI, PIHAK INDUSTRI PERLU MEMASTIKAN BAHAWA REKOD-REKOD BERHUBUNG PEMATUHAN STANDARD KESELAMATAN SERTA RANGKAIAN PEMASARAN MASING-MASING DISELENGGARA DENGAN BAIK BAGI MEMUDAHKAN PROSES PENGUATKUASAAN DIJALANKAN OLEH PIHAK KEMENTERIAN.

4.   JUSTIFIKASI BAGI MENGGUNA PAKAI KAEDAH SELF DECLARATION

· KAEDAH INI KURANG MEMBEBANKAN PIHAK INDUSTRI DARI SEGI KOS YANG PERLU DITANGGUNG;

· IANYA JUGA MENGURANGKAN JUMLAH PROSES YANG PERLU DIIKUTI OLEH INDUSTRI BAGI MEMATUHI PERATURAN-PERATURAN INI; DAN

· KEKURANGAN MAKMAL DALAM NEGARA YANG MENAWARKAN PENGUJIAN BERKAITAN.

5.   KESIMPULAN

· WALAUPUN PIHAK KEMENTERIAN MENGAMBIL PENDEKATAN YANG BERKONSEP ‘SELF ACCOUNTABILITY’, NAMUN PIHAK INDUSTRI MASIH PERLU MEMASTIKAN BAHAWA BARANG MAINAN MEREKA TELAH DIBUAT PENGUJIAN SEWAJARNYA DAN MEMATUHI STANDARD KESELAMATAN YANG TELAH DITETAPKAN. PIHAK KEMENTERIAN TIDAK AKAN BERKROMPOMI DALAM SEBARANG ISU YANG MELIBATKAN KESELAMATAN BARANG ATAUPUN PERKHIDMATAN DEMI MENJAGA KESEJAHTERAAN PENGGUNA MALAYSIA.

Toys Safety Issue - updates as at 03-08-09 1355 hours

Please be informed that there will be a Technical commitee on safety of toys meeting with SIRIM on the 21st August 2009 and for those members that has issues or questions in hand, please fax to us or email them to us.  Please use this opportunity to channel your concerns so that the implementation would have minimal inconvenience caused to all related. Regret to inform that SIRIM will not individually invite our members for the meeting but nevertheless will be represented by our association's vice president , Mr. David Yeow.

事项:《2009儿童玩具安全条例》事宜

有关您于727日来函询问以上事宜,今回复如下:

本公会曾于20071125日召集玩具业者的会员进行交流,并以11票对8票通

   过接纳《儿童玩具安全条例》一事。

 

根据了解,每项玩具将在经过马来西亚工业标准局(SIRIM)确认后,再加以编号

方可进口,一旦实施后肯定会增加业者成本上的负担,即使本公会若干会员曾在今

7 3日受邀与SIRIM官员对话,从中得知玩具业者除了政府指定的化验所之外,

也可以到受承认的化验所进行化验程序。

   然而,由于玩具含有季节性和流行性的因素,所以,本公会也至诚盼望政府慎重考虑。

 

自从去年发生在美国发生的安全条例风波后,目前一些拥有知名品牌的大公司,都非

    常谨慎看待此项问题。

 

根据了解,政府有关部门乃使用SIRIM的七项标准,作为儿童玩具安全条例的依据,  

    业者均可上网浏览有关资料或购买。

    国内从事出口的制造厂商,也都依据采购商的要求交货。

 

本公会要求政府有关当局,由于目前经济放缓,百物萧条,希望能够给业者订下适当

的宽限期。同时,本公会也要求有关当局派出相关人员,为玩具业者作全面解析,以

免业者误触法令。而本公会也责无旁贷,代为邀请来自霹雳食品玩具商公会和北马食

品玩具商公会的会员同业一齐作正面的交流。

 

 6 本公会也准备择日召集玩具同业进行交流。

Toys Safety Issue - updates as at 30-07-09

For all members dealing with toys, in 6 months time from July 2009, the Consumer Affairs Division of Ministry of Domestic Trade, Co-operatives and Consumerism would be implementing toys safety standards in Malaysia. Members are encouraged to update themselves on this requirement immediately. The seven safety standards can be purchased online at http://www.msonline.gov.my/ which works hand in hand with SIRIM. The below codes of safety standards are the minimal requirements for the standards to be implemented and will update if again if and when there are progress.

News Update as at 11-02-2009

Subject: APEC Business Travel Card

The APEC Business Travel Card was initiated by the Asia Pacific Economy Cooperation (APEC) to assist the business community who has trade relations within the APEC member countries.

This card will enable to minimize time and costs incurred by businessmen in keeping up with the visa requirements to enter the countries concerned.

All member countries for pre-clearance will share information of applicants before the card can be issued.

This card will allow smooth entry and exit flow at entry points in the countries concerned.

This card will indirectly promote trade relations among member countries.

To qualify for the usage of the APEC Business Travel Card, applicants must be actively involved in business for which their frequent presence in the countries are accounted for.

Information given by applicants will be distributed to all member countries for pre-clearance status.
